TERMS AND CONDITIONS for Abyssos Cruises

Welcome to ABYSSOS CRUISES! These Terms and Conditions govern the provision of private tour services, including boat excursions, car tours, landmark visits, and wine tasting experiences in Santorini (hereinafter referred to as “the Tour Services”). By booking and confirming a Tour Service with us, you (hereinafter referred to as “the Client” or “you”) agree to these Terms and Conditions.

1. GENERAL TERMS AND CONDITIONS OF SERVICE

These terms constitute a legally binding contract between [Your Company Name] (hereinafter referred to as “the Company,” “we,” “us,” or “our”) and the Client. The Company acts as an organizer and provider of private, tailored excursions and tours within the Santorini region, utilizing either private vehicles or private vessels (boats) as specified in the booking confirmation. All services are offered based on the information provided in our promotional materials, subject to these terms and operational capacity.

2. CANCELLATIONS, CHANGES TO YOUR BOOKING AND REFUNDS

2.1 Cancellation by the Client:

  • Deposit/Payment: All cancellations must be made in writing via email to [email protected]. The date of email receipt will be considered the official cancellation date.
  • Cancellations made days or more prior to the scheduled Tour Service: Full refund of the total cost, minus any non-refundable deposits or transaction fees already incurred by the Company.
  • Cancellations made between [7] and [3] days prior to the scheduled Tour Service: The Client will forfeit the initial deposit (or a penalty equal to [50]% of the total tour cost, whichever is greater).
  • Cancellations made less than [3] days prior to the scheduled Tour Service, or No-Shows: The Client will forfeit the full amount paid, and no refund will be issued.

2.2 Changes to Your Booking by the Client:

  • Requests for changes (date, time, itinerary, number of participants, etc.) must be submitted in writing.
  • Changes are subject to availability and the Company’s written confirmation. The Company reserves the right to charge an administration fee of [20%] for confirmed changes made within [10] days of the scheduled tour.
  • If a requested change results in a lower cost, a refund will be issued based on the revised cost, provided the change is made outside the cancellation penalty period defined in 2.1.

2.3 Cancellations or Changes by the Company:

  • If the Company is forced to cancel a Tour Service due to technical issues, safety concerns, or unforeseen operational difficulties (excluding Force Majeure, covered in Section 8), the Client will be offered a choice between a full refund or an alternative date/tour of equal value.
  • If the Company makes a significant change to the agreed-upon itinerary (e.g., changing the type of boat or car), the Client will be notified immediately. If the Client deems the change unacceptable, they may cancel and receive a full refund.

3. AVAILABILITY OF THE SERVICE

3.1 General Availability:

All Tour Services are subject to the availability of vehicles, vessels, guides, and specific wine estates or landmark access.

3.2 Boat Tours and Weather:

Services involving boats are dependent on favorable sea and weather conditions as determined by the Port Authority of Santorini (or other competent body) and the Captain’s judgment.

If a boat tour is cancelled by the Port Authority or the Captain due to weather/sea conditions, the Client will be offered:

  1. An alternative date/time (subject to availability).
  2. A comparable car tour/wine tasting experience (if possible).
  3. A full refund if no suitable alternative can be found.

3.3 Wine Tasting/Landmark Access:

While rare, access to certain landmarks or wineries may be restricted without prior notice due to private events or operational closures. The Company will substitute any restricted element with an alternative of equivalent quality and value.

4. PAYMENTS

  • Payment Requirement: A deposit of [50]% of the total tour cost, or full payment, is required to confirm a booking. The remaining balance (if any) is due no later than [3] days prior to the Tour Service date.
  • Payment Methods: We accept major credit cards, bank transfers, and [cash].
  • Failure to Pay: If the balance payment is not received by the due date, the Company reserves the right to treat the booking as cancelled by the Client, resulting in the forfeiture of the initial deposit.
  • Taxes: All prices quoted are inclusive of all applicable Greek taxes (VAT).

5. PRICES OF TRANSPORT SERVICES (AND TOUR INCLUSIONS)

  • The price confirmed at the time of booking is final, unless the Client requests changes resulting in increased costs (see Section 2.2).
  • Inclusions: Unless specified otherwise, prices for the private tours generally include: the private vehicle/vessel, professional driver/skipper, a dedicated guide (if booked), wine tasting fees, and entrance fees to specified landmarks.
  • Exclusions: Prices generally exclude: personal expenses, gratuities, additional meals or drinks not explicitly listed in the itinerary, and travel insurance.

6. BOOKING CONDITIONS AND CONTRACT OF EXCURSION

  • Contract Formation: A contract for the provision of the Tour Service is established only upon the Company’s written confirmation of the booking and receipt of the required payment (deposit or full amount).
  • Client Information: The Client must ensure that all details provided during the booking process (names, dates, times, medical conditions, dietary restrictions) are accurate. The Company relies on this information for planning and safety purposes.
  • Tour Specifics: The Client acknowledges that tours are private and non-transferable. The specific vessel or vehicle model is subject to change at the Company’s discretion, provided the substituted option is of equal or superior standard.

7. CUSTOMER OBLIGATIONS

  • Punctuality: Clients must adhere to the agreed-upon departure and meeting times. Delays caused by the Client may result in a shortened tour duration or charges for additional waiting time at a rate of [amount] per [time unit].
  • Safety and Conduct:

◦ Clients must comply with all reasonable instructions given by the guide, driver, or skipper, particularly concerning safety on board vessels or during wine tasting activities.
◦ The use of illegal substances is strictly forbidden.
◦ Consumption of excessive alcohol that leads to disruptive behavior may result in the immediate termination of the tour without refund.
◦ Clients are responsible for any damage caused to the vehicle, vessel, or property of third parties (e.g., wineries) due to their negligence or misconduct.

  • Health and Fitness: The Client is responsible for ensuring they are medically fit to undertake the Tour Services, particularly boat excursions. Clients with serious medical conditions or mobility issues must notify the Company at the time of booking.
  • Children: Children must be supervised by a responsible adult at all times.

8. UNFORESEEABLE CIRCUMSTANCES OR FORCE MAJEURE

The Company is not liable for delay or failure to perform its obligations if such failure is due to acts of God, extreme weather (affecting port operation or safety), fire, flood, labor disputes, civil unrest, political upheaval, government actions, or any other cause beyond the reasonable control of the Company (“Force Majeure”). In such events, the Company will endeavor to reschedule the service, but the Client acknowledges that the Company shall not be liable for any losses, costs, or damages incurred as a result.

9. CUSTOMER SERVICE AND COMPLAINTS

  • Contact: For emergency contact or immediate service issues during the tour, please call [+30 6973936600].
  • Complaints Procedure: Any complaints regarding the service must be reported immediately to the guide or driver at the time of the occurrence to allow us the opportunity to resolve the issue promptly.
  • Formal complaints must be submitted in writing via email to [[email protected]] within [10] days following the completion of the Tour Service, detailing the issue and the requested resolution. The Company will acknowledge receipt and respond within [10] business days.

10. APPLICABLE LAW AND JURISDICTION

This Agreement and the relationship between the Company and the Client shall be governed by and construed in accordance with the laws of the Hellenic Republic (Greece). The parties agree to submit to the exclusive jurisdiction of the Courts of [Thira, Santorini] for the resolution of any disputes.

11. ALTERNATIVE DISPUTE RESOLUTION (ADR)

The Company may be willing to participate in Alternative Dispute Resolution (ADR) procedures in an attempt to resolve disputes without resort to legal proceedings. Information on ADR bodies operating in Greece and relevant to consumer disputes can be provided upon request. Participation in ADR is voluntary and does not affect the Client’s legal rights to pursue resolution through the courts.
